Income-Driven Repayment Proposal to Be Reviewed Separately

The review process for the second round of negotiated rule-making proposals from the Department of Education concluded Tuesday. However, its most anticipated agenda item, income-driven repayment (IDR), is still under review, and the final proposal will be issued in a separate announcement, according to one department official.

Other regulatory agenda items that concluded their review process this week were expanding Pell Grants to incarcerated students and proposed rules to clarify changes in ownership of a college.

The department will consider IDR separately from the other two regulatory agenda items in order to “provide the most robust opportunities for public input and the greatest likelihood for finalizing all of these rules” before July 1, 2023, according to a department official.

The department is attempting to finalize all regulatory proposals to go into effect by July 1. Since IDR is able to be implemented early, it does not have to be finalized by the Nov. 1 deadline, as required by the other regulatory items.

It is unclear when official documents of the proposed rules will be released or when the IDR proposal will finish being reviewed.
